How to squander More HOA money – another example of NO Cost to costing LLHOA hundreds of dollars

This case is case #9 on our 22 lawsuits list (click to view), which is very similar to the case in blog post “How to squander HOA money – from ZERO cost to costing LLHOA thousands of dollars” (click to view).


Mr. TS made a prepayment to GPL for range key. After GPL departed, Barone refused to honor the range keys, TS sued LLHOA in small claim court for $68 plus damages. He won the case. The court awarded him $68 plus costs of $175 for a total of $243.


Consistent with what Barone has been doing, ignoring and defying court orders, the $243 judgment against LLHOA was not paid. TS filed form SC-134 with the court, order to produce statement of assets and to appear for examination (click to view). As of 12/20/2019, the total cost is $533, $290 in postjudgment costs plus the $243 judgment, and rising.


This is yet another case that the cost for LLHOA to resolve an issue could have been ZERO by honoring the range key, since the cost would be negligible to have allowed TS to hit golfballs that LLHOA already owned. Barone's actions ended up costing LLHOA hundreds of dollars. As of now, the cost is $533, the equivalent of 3 months of membership dues squandered for no apparent reason other than Barone felt like throwing our money away.


If Barone lacks fundamental business common sense and has no allegiance to the law, what about the three Board members, Umann, DiNapoli and Bromley, who allowed this behavior from their employee? Do they support Barone in not honoring the range key? Do they support Barone in defying a court order? Do they support Barone in making poor business decisions that cost LLHOA for the time paid employees spent in court to fight these ridiculous and avoidable lawsuits? Do they believe Barone's actions are defensible? If it were their own money, would they allow Barone to spend it in such a careless way?
