Anyone that has any type of current HR experience would know that ANY actions the Board may or have taken regarding the CEO and his performance....board members are prohibited from publicly discussing performance actions against any employee. To do so would subject them and he HOA to a lawsuit by the employee. Ironic...

Absolutely classic as this CEO and the three ‘friendly Board Members’ have not followed “current, old, any HR practices” at any/all times with the LLHOA employees; including the CEO hire.


Not an issue to raise, honestly. Lots of rocks to pick up. Lots of creepy crawlers underneath each.


By the nature of the position, it falls in a category open to Member discussion. Some may be praise. Some may not.


In kind, the Board falls in the same category. Members may express their satisfaction or dissatisfaction with the Board’s retention of the employee’s of the association that they feel are not fulfilling their needs as Members. This does not breach the veil of what action has or has not been taken against any employee.


However, it is responsible of the Board, CEO, and all employees to be responsive to the collective feedback of the Membership.


Let us not forget, the Members pay dues which funds the Corporation (Association).

The Members elect the Board to represent their interests and entrust them with fiduciary responsibility. The Board chooses to hire Staff and/or Outsource Resources to manage the assets of the Corporation, on behalf of the Members.


If any of these functions are not performed to the satisfaction of the Members, the Members may voice their opinion, hold a recall or call a special meeting with a ‘specific’ percentage of Members to vote out Board Member/s.


The key word here is “Members”. The Members may speak or take action. This is legal. It does not violate this ‘category’ of Staff rights. No Board Member has breached personnel records. Please don’t confuse the two.


You are correct. Action taken is private. Complaints by Members, goes with the territory for Board Members and Senior Staff in a Membership type job category.


Please... don’t propose more lawsuits that we’ll lose that could go into maintenance and infrastructure.

These letters where he thinks he knows legalese are embarrassing. ‘Undue influence’ is also nonsense. This is just a word salad that once again demonstrates that the board made a mistake by hiring someone who was totally unqualified and lacked any experience.

It appears from all of the posts that I've read that everything Chris Barone does at your club is embarrassing! He is an employee, is he not? Why don't they just get rid of the guy?!


The President and the board have a legal obligation to the membership to act in their best interest. It is obvious that they are not.
