For what are Umann, DiNapoli, Bromley fighting, to hold on to a position on the Board? Why?

Updated: May 30, 2020

Members raised a thought provoking point in their comments, featured below. Being on the Board is a non-paying volunteer job. Board members are elected to represent the membership. When a recall is lawfully petitioned, isn’t it the duty of the elected board members to conduct the recall to find out if the recall has the backing of the majority of the membership? Why on earth would Umann, Dinapoli, Bromley deny a recall lawfully petitioned?

What are they fighting for, holding on to being a Director on the Board? It is not Money, since board positions are non-paying volunteer jobs.

For What: Their ego?

Their need to be perceived the authority? Their sense of self-worth derive from their being on the Board?

Their desire to keep hidden their lies about LLHOA's financial health ?

Their arrogance that only they and their Friend can manage the LLHOA?

Their wish to keep their Friend in a job that pays him 50% over market rate?

Would love for someone to explain to me how a board can reject the petitioners’ right to hold a recall and then call the recall illegal because they rejected it. If a board can simply choose to reject a recall against them, what is the recourse for the HOA members to replace a board? Their position is ridiculous.

Marti,

I’m not trivializing the bylaws. What I see happening is people using and weaponizing the bylaws to try to prevent and then to dismiss a recall. This last recall was done by people who have gone out of their way - above and beyond - to follow the bylaws as they interpret them. And in this last election they received legal advice from an HOA attorney and the League of Women Voters to make sure they were following the rules. But you have people on the sidelines waiting to yell ”they’re violating the bylaws” to prevent the election. If they really cared about the bylaws they would have been working with the petitioners to have their concerns addressed. They don’t care about the bylaws for any reason other to try and stop the vote from counting.

Yes to recall, It took me a couple of reads of your post (last one above) for the main point to sink in. I got all hung up on procedure geeking... But, then, at least I think, I got your point! It is a bit hard to believe that someone would clammer on to a volunteer position on a community HOA board, when there is quite an indication that the community does not desire you to be in the position anymore. Why? Why would a person do that? It’s a volunteer gig that you were voted into and those who voted you in are now indicating that they’d like you to step down. You don’t, so they go so far as to enact a formal process to remove you and get a fine turn out in support. Why keep fighting to hang on? You aren’t supported by the community, at large, any longer. I’m sure you’re still loved by family and friends and probably a decent human, but the community you represent, just doesn’t want you representing them anymore. It’s kind of odd that someone would fight to hang onto a volunteer gig when their volunteering is no longer desired.

Head scratcher.

Thank you NoGPL1 for eloquently paraphrasing my thoughts more clearly than I did. Yes, that’s exactly my point.

Whew! I dunno about eloquent - kinda wordy and clunky - but I’m glad I reread your post! When the lightbulb went off in my head, I thought it was a great point! I think if it were me, I’d sadly, but gracefully fade off into the sunset.
